Terms of Service

"Account" means the account you create to access the Service.

"Content" means any video, audio, images, text, graphics, data, or other materials uploaded, generated, processed, or otherwise made available through the Service.

"User Content" means any Content that you upload, submit, or transmit to or through the Service.

"Generated Content" means Content created by or with the assistance of Envizion AI's AI-powered tools and agents.

"Credits" means the unit of value used to access certain features and processing capabilities within the Service.

You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Service. By creating an Account, you represent that you meet this requirement and that all information you provide is accurate, current, and complete.

You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized use. Envizion AI will not be liable for any loss arising from unauthorized access to your Account.

We reserve the right to suspend or terminate any Account that we reasonably believe violates these Terms, contains inaccurate information, or has been inactive for an extended period.

Envizion AI is an agentic AI video production platform that enables users to create, edit, and produce video content using AI-powered tools, agents, and automated workflows. The Service includes, but is not limited to:

• AI-powered video editing and generation tools
• Automated agent-based workflows for video production
• Template and preset libraries for video creation
• Asset management and media processing capabilities
• Collaboration and sharing features
• API access for programmatic integration
• Rendering and export services

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify users of material changes.

Your Content. You retain all ownership rights to User Content that you upload to the Service. By uploading User Content, you grant Envizion AI a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, process, and display your User Content solely for the purpose of operating, improving, and providing the Service to you.

Generated Content. Subject to your compliance with these Terms and applicable law, you own the Generated Content produced through your use of the Service, to the extent permitted by law. You are solely responsible for ensuring that your use of Generated Content complies with all applicable laws, including intellectual property and publicity rights.

Our Intellectual Property. The Service, including its software, design, features, documentation, and all underlying technology, is owned by Envizion AI and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use Envizion AI's trademarks, logos, or branding without prior written consent.

Feedback. If you provide us with suggestions, ideas, or feedback regarding the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use such feedback for any purpose without obligation to you.

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Upload, generate, or distribute Content that is unlawful, defamatory, obscene, fraudulent, or that promotes violence, discrimination, or illegal activities
• Generate deepfake or manipulated media intended to deceive, defraud, or harm individuals
• Infringe upon the intellectual property, privacy, or publicity rights of any third party
• Attempt to reverse-engineer, decompile, or extract the source code of the Service
• Circumvent or interfere with security features, rate limits, or access controls
• Use automated means (bots, scrapers) to access the Service except through our official API
• Resell, sublicense, or redistribute access to the Service without authorization
• Transmit viruses, malware, or any code designed to disrupt the Service
• Engage in any activity that imposes an unreasonable load on our infrastructure

We reserve the right to investigate and take appropriate action against anyone who violates these restrictions, including suspending or terminating access and reporting to law enforcement.

Plans & Pricing. Certain features of the Service require a paid subscription or the purchase of Credits. All fees are stated at the time of purchase and are non-refundable except as expressly set forth herein or as required by applicable law.

Recurring Billing. Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected). Your subscription will automatically renew unless you cancel before the end of the current billing period. You may cancel at any time through your Account settings.

Credits. Credits are consumed when you use certain processing features (rendering, AI generation, etc.). Unused Credits may expire as described in the applicable plan terms. Credit balances are non-transferable and non-refundable.

Price Changes. We may adjust pricing with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

Taxes. You are responsible for any applicable taxes, duties, or levies associated with your use of the Service, unless otherwise stated.

If you access the Service via our API, you agree to comply with our API documentation and any applicable rate limits. API keys are confidential and must not be shared or exposed publicly. We may revoke API access at any time if we determine that your usage violates these Terms or poses a risk to the Service or other users.

You are responsible for all activity that occurs through your API keys. We reserve the right to implement usage limits, throttling, and monitoring to ensure fair access for all users.

The Service may integrate with or link to third-party services, content providers, and platforms. These integrations are provided for convenience and are subject to the respective third-party terms and privacy policies. Envizion AI is not responsible for the availability, accuracy, or content of third-party services, and does not endorse any third-party products or services.

Your use of third-party media assets (stock footage, music, images) through the Service is subject to the applicable license terms of those assets. You are responsible for ensuring your use of such assets complies with their respective licenses.

By You. You may terminate your Account at any time by contacting us or through your Account settings. Termination does not entitle you to a refund of any prepaid fees or unused Credits.

By Us. We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violations of these Terms, fraudulent activity, non-payment, or extended inactivity.

Effect of Termination. Upon termination, your right to use the Service ceases immediately. We may delete your Account data after a reasonable retention period. Sections of these Terms that by their nature should survive termination will remain in effect.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, Envizion AI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. AI-GENERATED CONTENT MAY CONTAIN INACCURACIES, AND YOU ARE SOLELY RESPONSIBLE FOR REVIEWING AND VERIFYING ALL OUTPUT BEFORE USE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Envizion AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO Envizion AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

You agree to indemnify, defend, and hold harmless Envizion AI and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content or Generated Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, either party may pursue binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

We may revise these Terms from time to time. If we make material changes, we will provide notice through the Service or by email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and terminate your Account.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Envizion AI regarding the Service.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.

Force Majeure. Envizion AI shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, acts of government, internet disruptions, or third-party service outages.
